Terms of Service

These Terms govern your use of IntellyPilot, operated by Mondivio (KVK 90316630, VAT NL004805638B79), Rotterdam, the Netherlands. By creating an account or using the Service, you agree to these Terms.

1. The Service

IntellyPilot is an AI-powered marketing, sales, and customer-support platform. We provide it as software-as-a-service via intellypilot.com.

2. Account

You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. You must be at least 18 years old and authorised to bind your organisation.

3. Subscriptions and billing

  • Plans (Starter, Growth, Scale) renew monthly. Credit packs are one-time purchases.
  • Payments are processed by a third-party payment processor. Prices are in EUR, exclusive of VAT where applicable.
  • You can cancel at any time; the subscription remains active until the end of the paid period.
  • We do not refund unused time on monthly plans unless required by Dutch law.

4. Acceptable use

You agree not to use the Service to:

  • send spam, unsolicited messages, or content that violates platform policies of connected services;
  • generate or distribute illegal, harmful, deceptive, or infringing content;
  • reverse-engineer, resell, or abuse the Service or its AI capabilities;
  • exceed reasonable rate limits or interfere with other customers.

5. Your content

You retain ownership of content you upload or create using the Service. You grant us a limited licence to process, store, and display it solely to operate the Service.

6. AI output

AI-generated content may be inaccurate or unsuitable. You are responsible for reviewing output before publishing it or sending it to your customers.

7. Availability

We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance and third-party outages may affect the Service.

8. Liability

To the maximum extent permitted by Dutch law, our total liability for any claim arising from the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect or consequential damages.

9. Termination

We may suspend or terminate accounts that breach these Terms. You may cancel at any time from your billing settings.

10. Governing law

These Terms are governed by Dutch law. Disputes will be resolved by the competent courts in Rotterdam, the Netherlands.
